made in the Bill for separation of any or all of the Joint Services on the demand of either the Scots or Imperial Parliaments, or when the Parliament fail to agree on the proportion of the cost of the Joint Services to be borne by each, or the administration of the Joint Services.

The power of levying and collecting all taxes, including income tax, in Scotland shall be transferred to the Scots Parliament, and the taxes so levied and collected in Scotland shall be paid into a Scottish Treasury.

The expenditure connected with the aforesaid national services and departments which, on the appointed day, will come under the sole control of the Scots Parliament, shall be provided by the Scots Parliament alone. Expenditure connected with the administration of the Joint Services shall be paid partly by the English and partly by the Scottish Treasuries in proportions to be agreed upon between the two Governments, and in default of agreement, to be ascertained by the Joint Council hereinafter mentioned, subject to ratification by both Governments, and this arrangement shall continue until such time as all or any of the Joint Services are separated. If separation of all or any of these services should take place, each country shall then administer and finance its own service. A consultative council to be called the Joint Council shall be established for the purpose of ascertaining and declaring the rights of the two countries in any matters of common interest, where there is any disagreement between the two Governments on such matters. This Council shall meet as often as is deemed necessary by either Government, and full information on all matters referred to it shall be supplied to the Council by both Governments. The deliverances of the Council shall not be binding on both countries unless ratified by both Parliaments.

A Supreme Court of Scotland is substituted for the House of Lords as the final Court of Appeal, and all constitutional questions will be determined by that tribunal, subject to the right of any person to petition His Majesty for leave to appeal to His Majesty in Council.

Provide for the better Government of Scotland. A.D. 1927.

E it enacted by the King's most Excellent Majesty,

Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the 5 same, as follows:

1. On and after the appointed day there shall be Establishin Scotland a legislature consisting of His Majesty ment of the King and a House of Representatives which is liament. hereinafter called "the Scots Parliament.'

Subject to the provisions of this Act the Scots Legislative Parliament shall have power to make laws for the powers of peace, order, and good government of Scotland subject to the following limitations, namely, the Scots Parliament shall not have power to make laws in respect of 15 the following matters, or any of them, namely:

(1) The Crown, or the succession to the Crown, or a
Regency, or the property of the Crown (including
foreshore vested in the Crown or the Lord High
Commissioner to be appointed under the pro-
vision of this Act, except as respects the exercise
of his executive power in relation to Scottish
services as defined for the purposes of this Act;

or

(2) The making of peace or war, or matters arising
from a state of war; or the regulation of conduct
of any portion of His Majesty's subjects during

the existence of hostilities between Foreign
States with which His Majesty is at peace in
relation to those hostilities; or

(3) Treaties or any relations with Foreign States
or relations with other parts of His Majesty's 5
Dominions, or matters involving the contra-
vention of treaties or agreements with Foreign
States or any parts of His Majesty's Dominions,
or offences connected with any such treaties or
relation or procedure connected with the extra- 10
dition of criminals under any treaties, or the
return of fugitive offenders from or to any part
of His Majesty's Dominions; or

(4) Dignities or titles of honour; or

(5) Treason, felony, alienage, naturalisation, or aliens 15 as such, or domicile; or

(6) Trade with any place out of Scotland (except so far as trade may be affected by the exercise of the powers of taxation given to the Scots Parliament, or by the regulation of importation 20 for the sole purpose of preventing contagious disease, or by steps taken by means of inquiry or agency out of Scotland for the improvement of Scottish trade or for the protection of Scottish traders from fraud), the granting of bounties on 25 the export of goods, quarantine or navigation, including merchant shipping (except as respects inland waters, narrow sea navigation, the regulation of harbours and local health regulations): Provided that at any subsequent time all or any of 30 the limitations set forth in this section may be altered by agreement between the Imperial Parliament and the Scots Parliament.

3.-(1) The executive power in Scotland shall continue vested in His Majesty the King, and nothing in 35 this Act shall affect the exercise of that power except as respects Scottish services as defined for the purposes of this Act.

(2) The representative of the Crown in Scotland shall be called the Lord High Commissioner and shall be 40 appointed in like manner as the Governor-General of Canada, and in accordance with the practice observed in the making of such appointment.
