E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows:

1. In this Act

"Garden square
means any enclosed garden or
open space (other than a garden or open
space vested in or under the control and
maintenance of a public or local authority
for the use and enjoyment of the public)
which has been set apart or has existed
for the use, enjoyment, or benefit of the
inhabitants of any square, crescent, circus,
street, or other place, and which, during the
twenty-five years ending on the thirty-first
day of December, nineteen hundred and
twenty-six, has been (apart from any occu-
pation or user thereof by or on behalf of
the Crown or a Government Department in
connection with war purposes) maintained,
kept, or used as a garden square :

convenient for the use and enjoyment of a garden square as gardens or for the purposes of recreation or any like purpose.

"The Council" means the London County Council.

2.-(1) Subject to the provisions of this Act, it 5 shall not be lawful, without the sanction of the Council, for any person to erect any building or structure in, over, or upon any garden square in the administrative county of London.

(2) Any such sanction may be given subject to such 10 terms and conditions as the Council may think fit to impose, including, if thought fit, a condition that in consideration of such sanction the owner of the garden square on which it is desired to build shall (a) dedicate to the use and enjoyment of the public as an open space 15 such portion of the garden square as shall be agreed upon; or (b) transfer or convey to the Council a specified area of land for use as an open space; or (c) pay to the Council such sum of money as shall be agreed upon to be expended by the Council for the provision or extension 20 of an open space or open spaces.

3. Nothing in this Act shall apply to a garden square so long as it is vested in any commissioners, trustees, committee, or other body for the use, enjoyment, or benefit of the inhabitants of houses adjoining or in the vicinity 25 of the garden square.

4. In the application of this Act to the city of London the mayor, aldermen, and commons of the city of London in common council assembled shall be substituted for the Council.

5. This Act may be cited as the London Squares (Preservation) Act, 1927.
