CHAPTER CLXXXV.

A Further Supplement to the act entitled "An act to incorporate the Elizabethtown Steam Manufacturing Company," approved March fourth, eighteen hundred and forty-six.

1. BE IT ENACTED by the Senate and General Assembly of Power to issue the State of New Jersey, That it shall and may be lawful for by mortgage. the board of directors of the said "The Elizabethtown Steam Manufacturing Company" to issue bonds, payable within ten years, to an amount not exceeding fifty thousand dollars, said bonds to be secured by a mortgage upon the real estate of the said company; provided, the said bonds shall not be Proviso. issued in smaller denominations than five hundred dollars; and provided further, that the said bonds shall bear interest roviso. at the rate of seven per centum per annum, payable semiannually.

2. And be it enacted, That it shall and may be lawful for the said board of directors to offer for sale, and sell at the market price he bonds by this act authorized to be issued.

3. And be it enacted, That this act shall take effect immediately.

CHAPTER CLXXXVI.

An Act to authorize the grading of Central Avenue, in East

Orange.

1. BE IT ENACTED by the Senate and General Assembly of Power to sur the State of New Jersey, That it shall be the duty of the tablish grade township committee of the township of East Orange to make, avera or cause to be made, a survey and profile of so much of said. Central avenue as lies within the said township of East Orange, and to establish a grade thereon.

2. And be it enacted, That for the purpose of this act, the

said avenue shall be divided into three sections or divisions, as follows: the first section extending from the Newark line to the centre of Grove street; the second section from the centre of Grove street to the centre of Munn avenue; the third section from the centre of Munn avenue to the Orange line.

3. And be it enacted, That the said township committee shall cause said avenue to be graded and worked to the grade line established as aforesaid so soon as in the judgment of said committee the money appropriated to road purposes in said township will warrant the same; provided, that in prosecuting said work the committee shall cause each of the said divisions or sections to be graded and worked by itself, and shall ascertain the expense of working and grading each section.

4. And be it enacted, That whenever the entire expense of the working and grading of any one of said sections shall have been ascertained, including the cost of the survey and profile, if in the judgment of the township committee any part of the said expense should be borne by the owners of property along the line of such section, the said committee shall have power to appoint three disinterested persons, who shall assess upon said owners of any lands along the line of such section, such part of the said entire expense as may be directed to be assessed by the said committee; provided, the amount so assessed upon the land owners shall in no case exceed onethird the said entire expense; the basis of such assessment shall be the benefits which the persons so appointed as aforesaid shall deem the respective parcels of land along the line of such section to have received from the work done by virtue of this act; and the persons making the assessment shall give at least three days' notice to the land owners of the time and place of their meeting for the purpose of making said assessment; the said assessment shall be made in writing, and shall be reported to the town committee, and in case the said committee shall approve the same, they shall report the amounts to the township collector, who shall include them in the tax bills of the said land owners respectively; and the said sums so assessed are hereby made collectable in the same manner, at the same time, and by the same means with the ordinary township taxes levied upon real estate.

5. And be it enacted, That all acts and parts of acts inconsistent with the provisions of this act, be and the same are

hereby repealed, so far as the same may affect the working and grading of said Central avenue in East Orange.

6. And be it enacted, That this act shall take effect immediately.

CHAPTER CLXXXVII.

An Act making an appropriation for lot of land and trestle work for landing coal at the State Lunatic Asylum, for the cost of erecting and improving outbuildings, &c.

1. BE IT ENACTED by the Senate and General Assembly of Appropriation the State of New Jersey, That the sum of twenty thousand provements dollars be and is hereby appropriated to pay for land and the asylum. trestle work required for landing coal at the State Lunatic Asylum; for bakery, building and fixtures; for stable and carriage house and hay scales; for fixtures and apparatus for extinguishing fire; for extension and renewal of laundry building and machinery, and completing new buildings as per report of managers; and the further sum of five thousand dollars, as per report of joint committee, to defray the expenses of making extraordinary repairs, improvements and refurnishing older parts of asylum buildings.

2. And be it enacted, That the said moneys shall be paid by the treasurer to the managers of the asylum upon the warrant of the comptroller, who is hereby authorized and directed' to draw the same, at such times and in such sums as the managers may require.

3. And be it enacted, That this act shall take effect immediately.

CHAPTER CLXXXVIII.

An Act to facilitate the drainage of swamp and meadow lands in the township of Landis, in the county of Cumberland, and in the township of Buena Vista, in the county of Atlantic.

WHEREAS, the interests of a large number of persons residing in the township of Landis, in the county of Cumberland, and in the township of Buena Vista, in the county of Atlantic, would be greatly promoted by the draining of large tracts of swamp and meadow land along certain streams; and whereas, the frequent overflowing of said swamp and meadow lands materially interferes with the cultivation of the same, and the construction, maintenance, and use of suitable highways of travel thereon for the accommodation of the people; therefore,

1. BE IT ENACTED by the Senate and General Assembly of and drain low the State of New Jersey, That the overseers of the highways in the township of Landis, in the county of Cumberland, and in the township of Buena Vista, in the county of Atlantic, are hereby authorized and required to ditch and drain the swamp and low lands in their respective districts in the said townships where such ditching and draining shall seem to them necessary, and at all times to keep such ditches free and open for the proper drainage and improvement of the lands of the said townships.

And be it enacted, That after the draining of any lands shall have been completed, it shall be lawful for the said overseers of the highways, and they are hereby required to assess, in their respective districts, upon the lands so drained, the price and expenses of draining them, and collect the same annually; provided, however, that if any of said overseers of the highway shall fail to keep any portion of said lands in his district properly drained, he shall not collect or cause to be collected any tax upon such portion of said lands in the year or years when such failure shall happen.

cated, and such assessments shall thereupon become a lien upon said lands, and in default of payment for the space of two months thereafter, said lands, after eight weeks' advertisement in one or more public newspapers of the county in which such lands are situated, shall be sold at public sale for the shortest term of years to any person or persons who will pay the amount of said tax and the expenses of said sale; and any of said lands so sold may be redeemed from such sale by the owner or owners thereof within three years from the date of said sale by paying to the overseer of the highways of the district in which such land may be, for the benefit of the purchaser, the sum paid by the said purchaser at said sale with interest thereon, at the rate of twelve per centum per annum ; but if any of said lands are not so redeemed as aforesaid within three years from the date of the sale thereof, then the purchaser thereof shall continue to have, hold, use, enjoy, and possess such lands so sold during the full term for which said sale shall have been made.

4. And be it enacted, That this act shall take effect immediately.

CHAPTER CLXXXIX.

A Further Supplement to an act entitled "An Act to incorporate the New Jersey Building Company," approved March eleventh, eighteen hundred and sixty-four.

1. BE IT ENACTED by the Senate and General Assembly of Change of the State of New Jersey, That the corporation created by the name. act to which this is a supplement, shall hereafter be called "The Derrom Building Company," and by that name may possess and exercise all the powers, rights and privileges conferred by said act and the supplement thereto, anything therein to the contrary notwithstanding.

2. And be it enacted, That this act shall take effect immediately.
