of this Act as to closing hours, that person
(in this section referred to as "the defendant ")
fails to prove that the person to whom the
intoxicating liquor was sold (in this section
referred to as the purchaser") was a bonâ 5
fide traveller, but the court are satisfied that
the defendant truly believed that the pur-
chaser was a bonâ fide traveller, and further
that the defendant took all reasonable pre-
cautions to ascertain whether or not the pur- 10
chaser was a bonâ fide traveller, the court shall
deal with the case as against the defendant
as if the purchaser had been a bonâ fide traveller,
and if they think that the purchaser falsely
represented himself to be a bonâ fide traveller, 15
the court may direct proceedings to be insti-
tuted against the purchaser under this Part of
this Act.

(3) A person for the purposes of this Part
of this Act shall not be deemed to be a bonâ 20
fide traveller unless the place where he lodged
during the preceding night is at least three
miles distant from the place where he demands
to be supplied with liquor, that distance to be
calculated by the nearest public thoroughfare. 25
(1) This Act may be cited as the Licensing

Act, 1926.

(2) This Act shall be construed as one with the Licensing Acts, 1910 and 1921, and those Acts and this Act may be cited together as the Licensing Acts, 1910 30 to 1926.

(3) This Act shall not apply to Scotland.

(4) This Act shall come into operation at the expiration of fourteen days after the passing thereof.

Confirm a Scheme of the Charity Commissioners A.D. 1926. for the application or management of the Charities consisting of the London Road Congregational Chapel and the net proceeds of sale of the Trust Property in Hanover Place both in the Borough of Brighton in the County of Sussex.

HEREAS the Charity Commissioners in their report to His Majesty of their proceedings during the year nineteen hundred and twenty-five reported that they had approved and certified a Scheme for the appli5 cation or management of the charities consisting of(1) the London Road Congregational Chapel comprised in an Indenture dated 8th February 1830 to which Charity the Charitable Trusts Acts. 1853 to 1914 were extended by an Order of the Charity Commissioners of the 7th October 1924;

(2) the net proceeds of sale of the trust property in
Hanover Place comprised in an Indenture
dated 9th August 1826;

both in the borough of Brighton in the county of Sussex :

And whereas it is expedient that the Scheme as the same is fully set out and defined in the schedule to this Act should be confirmed:

Be it therefore enacted by the King's most Excellent Majesty by and with the advice and consent of the Lords

tion of Scheme.

Short title.

1. The said Scheme is hereby confirmed Provided always that nothing in this Act or in the said Scheme 5 shall be held to interfere with the ordinary jurisdiction over endowed charities now exerciseable or hereafter to become exerciseable by the High Court of Justice and the Charity Commissioners.

2. This Act may be cited as the Brighton (London 10 Road) Congregational Chapel Charities Scheme Confirmation Act 1926.
