#1 signated, cause the vote of the qualified voters of the county, at the several election precincts and places of voting in C said county, to be taken upon the question, whether or not, the court shall subscribe the stock as proposed; and in all matters pertaining to the taking of said vote, the subscribing for said stock, the issuing and execution of said bonds, the levying and collecting a tax to pay the interest thereon, and the appropriation and disbursement of the funds arising therefrom, the county court shall be governed and regulated, except so far as is provided for in this act, by the provisions of an act of the general assembly of Kentucky, entitled, an act to authorize the county of Graves to hold railroad stock, approved January 3d, 1852. P § 13. That said company is hereby authorized to regulate the time and manner in which goods and passengers shall be transported, taken, and carried on said road; and shall have power to erect and maintain toll houses and other buildings for the accommodation of their concerns, as they may deem suitable for their interest; and it shall be lawful for the company from time to time to fix, regulate, and receive the toll and charges by them to be received for transportation of persons or property on their said road or way aforesaid, hereby authorized to be constructed, erected, built, or used, or any part thereof. §14. That if any person or persons will or shall willfully do, or cause to be done, any act or acts whatsoever whereby any building, construction, or works of said company, or any engine, machinery, or structure, or any matter or thing appertaining to the same, shall be stopped, obstructed, impaired, weakened, injured, or destroyed, the person or persons so offending, shall be deemed guilty of a misdemeanor, and shall forfeit and pay to said company double the amount of damages sustained by reason of such offenses or injury, to be recovered in the name of said corporation, with costs of suit by action of debt. 15. That the directors of said company may require the payment of the sum or sums subscribed to the capital stock of said company, at such times, and in such proportions, and upon such conditions as they may deem fit; and in case any stockholder shall refuse or neglect to make payment pursuant to the requisition of the board of directors, the stock of such stockholder may be sold by the directors of said corporation, at public auction, after the lapse of ninety days from the time when the payment became due, and the surplus money, the avails of such sale, after deducting the payments due and interest thereupon, and the necessary expenses of sale shall be paid over to such delinquent stockholder. § 16. That the property owned by said company shall at all times be subject to taxation in the same manner and to the same extent as similar property owned by other railroad companies. 1854. 1854. 17. That if said railroad shall not be commenced within five years from the passage of this act, and shall not be finished within ten years from the time of commencement, then this act to be void. Be it enacted by the General Assembly of the Commonwealth of Kentucky, That the auditor of public accounts be and he is hereby directed to issue his warrant upon the Treasurer of this state in favor of Obediah Parsons for the sum of one hundred dollars, to be paid out of any money in the treasury not otherwise appropriated.
