and in page 8, line 2, by leaving out the words "at the prescribed rate on those contributions," and by inserting the words "as aforesaid "-(Mr. Neville Chamberlain),— instead thereof.

Clause 5.

An Amendment proposed, in page 8, line 9, to leave out all the words from the word "be" to the end of the paragraph, in order to insert the words "in the case of a borough the council of the borough and elsewhere the county council"-(Sir Douglas Newton),-instead thereof. -Question proposed, "That the words proposed to be left out stand part of the Clause."

Amendment, by leave, withdrawn.

Another Amendment made, in page 8, line 18, at the end, by inserting the words

"(2) The council of a county and the council of any county district within the county may, if it appears to the council of the county that the administration of their scheme under this Act will be thereby facilitated, enter into arrangements under which the council of the county district may undertake on behalf of the council of the county any duties connected with the administration of the scheme other than the approval or disapproval of applications for assistance, the payment of any grant or loan or instalment of a loan, or the institution of legal proceedings in the event of a breach of any of the conditions subject to which a grant or loan is made "--(Mr. Chamberlain).

Another Amendment proposed, in page 9, line 4, at the end, to add the words :

(5) Every local authority shall publish annually a report of their proceedings under this Act and such report shall contain, amongst other things, the following particulars, namely

(a) The names and addresses of the owners to whom assistance has been given under this Act;

(b) The houses in respect of which such assistance has been given and the works to be carried out in respect thereof;

(c) The amount and nature of the assistance. A copy of such report shall be supplied to any local government elector within the area of the local authority applying therefor upon payment of such sum, not exceeding sixpence, as the authority may fix --(Mr. Greenwood).

Question put, "That those words be there added.”—The Committee divided :

Amendments made, in page 9, line 14, at the end, by inserting the words "and any loan may, if so agreed, be secured upon lands of which the dwelling in respect of which the loan is being made forms a part, but nothing herein contained shall authorise a local authority to lend more than the sum which they would have been authorised to lend had the loan been secured only upon the dwelling "; and in page 9, line 14, after the last inserted Amendment, by inserting the words :

"(c) It is hereby declared that the paragraph of sub-section (2) of section two which precludes assistance being given to persons having a limited leasehold interest is not applicable in the case of a landholder within the meaning of the Small Landholders (Scotland) Acts, 1886 to 1911 (in this section referred to as a 'landholder') "--(The Lord Advocate).

Other Amendments made, in page 9, line 17, at the end, by inserting the words :-

"(e) For the purpose of assistance by way of grant in relation to a dwelling occupied by a landholder the following provisions shall have effect :

(i) The landholder or his statutory successor, so long as in occupation of the holding, shall be deemed to be the owner of the dwelling;

(ii) If, at any time within the period during which conditions apply by virtue of this Act in relation to the dwelling, compensation becomes payable by the landlord to the landholder under the said Small Landholders Acts in respect of permanent improvements, including the dwelling, the local authority may require that such compensation shall be assessed by the Land Court;

(iii) In assessing such compensation, the Land Court shall fix the proportion, if any, thereof as is, in their opinion, attributable to the grant, and the proportion so fixed shall not be payable to the landholder but shall be recoverable by the local authority from the landlord;

(iv) Upon payment of such amount the conditions which apply in relation to the dwelling shall cease to have effect, and the local authority shall be liable to repay to the Scottish Board of Health a sum bearing the same proportion to the amount of the contributions made by the Board in respect of the dwelling as the amount recoverable by the local authority from the landlord bears to the amount of the grant;"

and in page 9, line 23, by leaving out all the words from the word "with" to the word "shall," in line 27, and by

inserting the words "interest as aforesaid "-(The Lord Advocate),-instead thereof.

Another Amendment made, in page 10, line 33, at the end, by adding the words :

"(j) A reference to The Housing Act, 1925, shall be construed as a reference to The Housing (Scotland) Act, 1925 "—(Mr. Thomas Kennedy).

Clause, as amended, agreed to.

Clause 7.

Amendments made, in page 10, line 39, at the end, by inserting the words:

"The expression 'street' has the same meaning as in The Housing Act, 1925;

and in page 11, line 11, at the end, by adding the words "The expression 'rack rent' has the same meaning as in The Public Health Act, 1875"-(Mr. Greenwood).

Clause, as amended, agreed to.

New Clause (" Acceptance of assistance not to disqualify for membership of local authority ")-(Sir Kingsley Wood) -brought up, and read the first and second time, and added to the Bill.

Another New Clause ("Offences ") brought up, and read the first time as follows:-

"If any person obtains or attempts to obtain any assistance under this Act by any false or misleading statement he shall be guilty of a misdemeanour, and shall be liable, upon summary conviction, to be imprisoned with or without hard labour for any term not exceeding three months or to a fine not exceeding one hundred pounds, or to both such imprisonment and such fine "-(Mr. Greenwood).

Motion made, and Question, "That the Clause be read a second time,"-put, and negatived.

Another New Clause ("Prohibition on persons interested voting as members of local authorities ")-(Sir Kingsley

Wood)-brought up, and read the first and second time, and added to the Bill.

An Amendment proposed, in page 12, line 9, at the end, to insert the words:

"2. The applicant shall in his application specify the nature and the amount of the assistance under this Act which he desires "-(Mr. Greenwood).

An Amendment made, in page 12, line 14, by leaving out the words "such part thereof," and by inserting the words "in a case where assistance is to be given by way of loan, of such part of the works "—(Sir Kingsley Wood), -instead thereof.
