4. The Chairman of the Ouse Board shall up to the said first day of November receive by way of remuneration such sum as the Minister, with the approval of the Treasury, may from time to time direct, and any such remuneration shall, for the purposes of this Act, be deemed to be part of the expenses incurred by the 5 Board in the execution of the works set out in the Third Schedule to this Act.

5. As from the said first day of November the Board shall be composed of the following persons, namely :

Two persons to be appointed by the Minister;

One person to be appointed by the King's Lynn Con-
servancy Board;

One person to be appointed by the Council of the
Administrative County of Norfolk;

One person to be appointed by the Council of the 15
Administrative County of West Suffolk;

One person to be appointed by the Council of the
Administrative County of Cambridge;

One person to be appointed by the Council of the
Administrative County of the Isle of Ely;
One person to be appointed by the Council of the
Administrative County of Huntingdon ;

Three persons to be appointed by the Middle Level
Commissioners;

Three persons to be appointed by the South Level Board; 25
Two persons to be elected in such manner as the Minister

may by order prescribe to represent so much of the
lowlands as is not included in the Middle Level
District or the South Level District.

6. For the purposes of this Schedule the electors for each. 30 electoral district shall consist of the persons who are owners of hereditaments situate in that district, and the person who was on the first day of July next before the date of the election assessed to the poor rate, or, after the date on which in pursuance of the Rating and Valuation Act, 1925, a general 35 Geo. 5. c. 90. rate is made for any district in lieu of the poor rate, assessed to the general rate, in respect of any hereditament shall be deemed to be the owner of that hereditament:

Provided that, where a demand for any drainage rate made by the Board in respect of any hereditament has been duly made 40 on the person assessed thereto not less than one month before the date of an election and the rate so demanded has not been paid in full by him, that person shall not be entitled to vote in respect of his qualification as owner of that hereditament at that election.

PART II.

CONSTITUTION OF THE SOUTH LEVEL BOARD.

1. The South Level Board shall consist of fifteen members.

2. On its first constitution the South Level Board shall be

3. After the expiration of the term of office of the first members of the South Level Board the Board shall be composed of five appointed members and ten elected members.

The appointed members shall be appointed as follows, that 30 is to say:—

The elected members shall be elected in manner hereinafter provided by the drainage authorities (other than the Ouse Board) 40 whose area, or any part of whose area, is within the South Level district.

4. At any election of members of the South Level Board the drainage authorities aforesaid shall be entitled to votes in accordance with the following scale :

1. No person shall be qualified for election as a member of the Ouse Board unless he is either— 20

(a) absolutely entitled as owner to not less than ten acres of land in respect of which a drainage rate may be levied by the Board and situate in the electoral district for which he is a candidate for election; or

(b) a member, officer or servant of some body of persons, 25 corporate or unincorporate, which is such an owner as aforesaid and has been nominated by that body as a candidate for election:

Provided that no such owner as aforesaid and no such member, officer or servant of a body corporate as aforesaid 30 shall be qualified for election if at the time of the election any drainage rates levied by the Board, being rates in respect of which a demand for payment has been made on that person or body not less than one calendar month before the date of the election, have not been duly paid.

2. The Minister, after consultation with the Ouse Board, may make rules for carrying into effect the provisions of this Schedule relating to elections of members of the Board, and such rules shall in particular contain provisions

(i) for allowing any body of persons, corporate or unincor- 40 porate, which is the owner of any land to vote by a deputy at any election;

(ii) for the preparation of registers of electors, including A.D. 1927.
provisions with respect to the making of objections to
entries in any such registers and the hearing and
determination of such objections; and

(iii) with respect to the holding and conduct of elections,
including provisions as to returning officers, nominations,
polls, and the counting of votes.

3. All expenses incurred by the Ouse Board in connection with elections of members of the Board shall be defrayed as part 10 of the general expenses of the Board.

4. The provisions of this Part of this Schedule shall apply to the South Level Board as they apply to the Ouse Board subject to the following modifications:—

(i) In paragraph 1 (a) for the reference to the electoral
district for which a person is elected there shall be
substituted a reference to the South Level district
exclusive of any part of that district which is not
situate in the area of any other drainage authority
except the Ouse Board:

(ii) after paragraph 1 (a) there shall be inserted the following:

" or

(aa) the occupier, whether under a tenancy from
year to year or otherwise, of not less than twenty
acres of such land as aforesaid; or"

(iii) Sub-paragraph (i) of paragraph 2 shall not apply;
(iv) after the word "owner," wherever it occurs, except
in sub-paragraph (a) of paragraph 1, there shall be
inserted the words "or occupier".

PART IV.

PROVISIONS AS TO MEMBERS AND PROCEEDINGS
OF THE BOARDS.

1. The first members of the Board shall hold office until the first day of November in the calendar year next following the calendar year in which the appointed day occurs.

2. Any members of the Board other than the first members thereof shall come into office on the first day of November next after the day on which they are appointed or elected, as the case may be, and shall hold office for a term of three years: Provided that

(a) any member may resign his office by notice in writing
under his hand given to the Chairman of the Board;
and

(b) if any member becomes bankrupt he shall vacate his

(c) in the case of an appointed member the body or person
by whom he was appointed may at any time revoke
the appointment; and

(d) if, where an appointed member vacates his office by
lapse of time, no person has before the date on which 5
he so vacates his office been appointed in his place,
he shall, subject to the provisions of this Schedule,
continue to hold office until a person is duly appointed
in his place.

3. If for any reason whatsoever the place of a member of 10
the Board becomes vacant before the end of his term of office,
the vacancy shall be filled in the case of an appointed member
by the body or person by whom the vacating member was
appointed and, in the case of an elected member, by the election
by the Board of a new member:

Provided that, where the unexpired portion of the term of office of the vacating member is less than six months, the vacancy shall not be filled.

4. A person appointed or elected to fill a casual vacancy shall hold office so long only as the vacating member would 20 have held office.

5. A person who is an undischarged bankrupt shall be ineligible for appointment or election as a member of the Board.

6. A vacating member shall, subject to the provisions of this Schedule, be eligible for re-appointment or re-election. 25

7. The powers of the Board may be exercised notwithstanding any vacancy in their number.

8. The Board may, with the approval of the Minister, make rules

(a) for regulating the proceedings, including quorum, of the 30 Board; and

(b) with respect to the appointment (subject to the pro-
visions of this Act) of a chairman; and

(c) for enabling the Board to constitute committees; and
(d) for authorising the delegation to committees of any of 35
the powers of the Board and for regulating the pro-
ceedings, including quorum, of committees.

9. Section sixty-eight, except paragraph (8) thereof, paragraph (1) of section sixty-nine and section seventy of the Land Drainage Act, 1861, shall not apply as respects the Board.

10. The first meeting of the Board shall be held on the appointed day and at such time and place as may be fixed by the Minister, and the Minister shall cause notice of the meeting to be sent by post to each member of the Board not less than fourteen days before the appointed day.

11. The Minister may, if he thinks fit, by order authorise the Board to repay to the members thereof the whole or any part of any travelling expenses incurred by them in attending meetings of the Board.
