ing to the form before appointed: And That all and every fuch, perfon, who fhall (without fome lawful Impediment, to be allowed and approved by the Ordinary of the place) neglect or refufe to do the fame within the time aforefaid, or (in cafe of fuch Impediment) within one month after such Impediment removed fhall ipfo fatto be deprived of all his faid Ecclefiaftical Benefices and Promotions; and That from thenceforth, it fhall and may be lawful to, and for all Patrons, and Donors, of all and fingular the faid Ecclefiaftical Be nefices and Promotions, or any of them (according to their respective Rights and Titles) to prefent, or collate to the fame, as though the perfon or perfons fo offending, or neglecting, were dead. 9:

And be it further enacted by the Authority! aforefaid, That in all places, where the proper Incumbent of any Parfonage, or Vicarages or Be nefice with Cure doth refide on his Living,ạnd keep a Curate, the Incumbent himself in perfon (not having fome lawful Impediment, to be allowed by the Ordinary of the place) fhall once (at the leaft) in every month openly and publickly read the Common prayers and Service, in, and by the faid Book prefcribed, and if there be Occafion adminifter each of the Sacraments and other Rites, of the Church, in the Parish Church or Chapel, of, or belonging to the fame Parfonage, Vicarage, or Benefice, in fuch order, mane ner and form, as in, and by the laid Book is ape pointed, upon pain to forfeit the fum of Five

pounds to the ufe of the poor of the Parish for every offence, upon conviction by confeffion, or proof of two credible Witneffes upon oath, before two Juftices of the Peace of the County, City, or Town-Corporate where the offence fhall be committed, (which Oath the faid Juftices are hereby impowered to adminifter) and in default of payment within ten days, to be levied by diftrefs, and fale of the goods and chattels of the Offender, by the Warrant of the faid Juftices, by the Church-wardens, or Overfeers of the Poor of the faid Parish, rendering the furplufage to the party..

And be it further enacted by the Authority aforefaid, That every Dean, Canon, and Prebendary of every Cathedral, or Collegiate Church, and all Mafters, and other Heads, Fellows, Chaplains, and Tutors of, or in any College, Houle of Learning, or Hofpital, and every publick Profeffor, and Reader in either of the Univerfities, and in every College elsewhere, and every Parfon, Vicar, Curate, Lecturer, and every other perfon in holy Orders, and every Schoolmafter keeping any publick, or private School, and every perfon Inftructing, or Teaching any youth in any houfe or private family as a Tutor, or School-mafter, who upon the Firit day of May, which fhall be in the year of our Lord God, One thoufand fix hundred fixty-two, or at any time thereafter fhall be incumbent, or have poffeffion of any Deanry, Canonry,, Prebend, Mastership, Headship, Fellowship, Profeffor's

place, or Reader's place, Parfonage, Vicarage, or any other Ecclefiaftical Dignity or Promotion, or of any Curate's place, Lecture, or School; or fhall inftru&t or teach any youth as Tutor, or Schoolmafter, fhall before the Feaft-day of St. Bartholomew, which fhall be in the year of our Lord One thoufand fix hundred fixty two, or at or before his or their refpective admiffion to be Incumbent, or have poffeffion aforefaid, fubfcribe the Declaration or Acknowledgment following, Scilicet.

Do declare that it is not lawful, upon any pretence whatfoever, to take Arms against the King, and that I do abhor that traiterous Pofition of taking Arms, by His Authority, ageinft His Perfon, or against those that are commiffionated by Him; and that I will "conform to the Liturgy of the Church of Eng"land, as it is now by Law eftablished. And I "do declare that I do hold, there lies no Obli

gation upon me, or on any other perfon, from "the Oath, commonly called the Solemn League

and Covenant, to endeavour any change or al"teration of Government, either in Church or "State; and that the fame was in itself an un"lawful Oath; and impofed upon the Subjects "of this Realm against the known Laws and "Liberties of this Kingdom."

Which faid Declaration and Acknowledgment shall be fubscribed by every of the said Masters

and

and other Heads, Fellows, Chaplains, and Tutors of, or in any College, Hall, or House of Learning, and by every publick Profeffor and Reader in either of the Univerfities, before the Vicechancellor of the refpective Universities for the time being, or his Deputy; And the faid Declaration, or Acknowledgment fhall be fubfcribed before the respective Archbishop, Bishop, or Ordinary of the Diocefe, by every other perfon hereby enjoined to fubfcribe the fame, upon pain, that all and every of the perfons aforefaid, failing in fuch fubfcription, fhall lofe and forfeit fuch refpective Deanry, Canonry, Prebend, Mafterfhip, Headship, Fellowship, Profeffor's place, Reader's place, Parfonage, Vicarage, Ecclefiaftical Dignity or, Promotion, Curate's place, Lecture, and School, and fhall be utterly disabled, and ipfo facto deprived of the fame; and that every fuch refpective Deanry, Canonry, Prebend, Mastership, Headfhip, Fellowship, Profeffor's place, Reader's place, Parfonage, Vicarage, Ecclefiaftical Dignity, or Promotion, Curate's place, Lecture and School fhall be void, as if fuch perfon fo failing were naturally dead.

And if any School-mafter or other perfon, infructing or teaching Youth in any private Houfe or Family, as a Tutor or School-mafter, fhall Inftruct or Teach any Youth as a Tutor or School-mafter, before Licence obtained from his respective Archbishop, Bishop, or Ordinary of the Diocefe, according to the Laws and Statutes of this Realm (for which he fhall pay twelve pence

only) and before fuch fubfcription and acknowledgment made as aforefaid; Then every fuch School-mafter and other, Inftru&ting and Teaching as aforefaid, fhall for the firft offence fuffer three months Imprifonment, without Bail or Mainprize; and for every fecond and other fuch offence fhall fuffer three months Imprisonment without Bail or Mainprize, and also forfeit to His Majefty the fum of five pounds.

And after fuch fubfcription made, every fuch Parfon, Vicar, Curate, and Lecturer fhall procure a certificate under the Hand and Seal of the refpective Archbishop, Bifhop, or Ordinary of the Diocese, (who are hereby enjoined and required upon demand to make and deliver the fame) and fhall publickly and openly read the fame, together with the Declaration, or Acknow ledgment aforefaid, upon fome Lord's day within three months next following, in his ParishChurch where he is to officiate, in the presence of the Congregation there affembled, in the time of Divine Service; upon pain that every perfon failing therein fhall lofe fuch Parfonage, Vicarage, or Benefice, Curate's place, or Lecturer's place refpectively, and shall be utterly disabled, and ipfo fatto deprived of the fame; And that the aid Parfonage, Vicarage, or Benefice, Curate's place, or Lecturer's place fhall be void, as if he were naturally dead.

Provided always, that from and after the Twenty-fifth day of March, which fhall be in the year of our Lord God, One thoufand fix hundred
