Goffe street, thence north-westerly through the center of Goffe street to the center of Orchard street, thence northerly through the center of Orchard street to the city limit, thence westerly and southerly by the city limit to the center of Chapel street, thence easterly through the center of Chapel street to the center of York street, thence northerly through the center of York street to the point of beginning, shall be and remain ward number ten.

So much of said city as is included within the following boundaries, to wit: by a line commencing at a point on Barnesville bridge coincident with the intersection of the central line of Grand street and the center of the westerly channel of Mill river, thence continuing southerly through the center of the westerly channel of Mill river to its junction with the main channel of said river, thence southerly through the center of the main channel of said river to the city limit, thence easterly and northerly by the city limit in Quinnipiac river to a point coinci dent with the central line of East Grand street, thence westerly through the center of Quinnipiac bridge and East Grand street to the point of beginning, shall be and remain ward number eleven.

So much of said city as is included within the following boundaries, to wit: by a line commencing at a point on Barnesville bridge, coincident with the intersection of the central line of Grand street and the center of the westerly channel of Mill river, thence continuing_easterly through the center of said bridge and the center of East Grand street to the city limit in Quinnipiac river, thence northerly and north-westerly by the city limit to the center of the channel of Mill river, thence southerly following the center of said channel to the point where said river is divided into two channels, thence through the center of the west channel to the point of beginning, shall be and remain ward number twelve.

SEC. 2. On the first Tuesday of December, A. D. 1878, and every second year thereafter, the freemen of said city shall elect, by ballot, from among their number, as prescribed by law, a mayor, clerk and auditor, who shall hold their respective offices for the term of two years, from and after the first day of January next succeeding their election; and on the first Tuesday of December, 1877, and every year thereafter, the freemen of said city shall elect, by ballot, from among their number, as prescribed by law, a treasurer and sheriff, who shall hold their respective offices for one year from and after the first day of January next succeeding their election, and the freemen resident in each ward of said city shall, on said first Tuesday of Decem

ber, A. D. 1877, further elect by ballot, from among their number, as prescribed by law, two aldermen, one of whom shall hold said office for the term of two years, from and after the first day of January next succeeding his election, and the other shall hold said office for the term of one year from and after the first day of January next succeeding his election; the term of office of each of said aldermen shall be designated upon the ballot opposite the names of the candidates; and on the first Tuesday of December in each succeeding year the freemen resident in each ward of said city shall elect, by ballot, from among their number, as prescribed by law, one alderman, who shall hold said office for the term of two years, from and after the first day of January next succeeding his election; also, on the said first Tuesday of December, A. D. 1877, and on the first Tuesday of December in each year thereafter, the freemen resident in each ward of said city shall further elect, by ballot, from among their number, as prescribed by law, three councilmen who shall hold said office for the term of one year from and after the first day of January next succeeding their election. All said officers to be elected by plurality vote, but if by reason of an equality of votes, there shall be no choice of any of the officers named in this section, then the court of common council of said city shall provide for the holding of a new election within fifteen days from aud after the time such failure to elect shall be made known.

SEC. 3. The terms of office of all the aldermen and councilmen of said city then in office, shall expire on the thirty-first day of December, 1877.

SEC. 4. The present members of the boards of road, police and fire commissioners, shall continue in office for one month beyond the term for which they were originally appointed, and all future appointments to said boards shall be made in the manner and for the same length of time as now provided, except that said appointments shall be made in the month of January in each year, and the terms of office shall commence on the first day of February next succeeding.

SEC. 5. Any member of the board of road, police and fire commissioners, shall be subject to removal for cause upon charges made in writing by any member of either board of the court of common council, provided said charges are found to be sustained by a two-thirds vote of said board of aldermen.

SEC. 6. The presiding officer of each board of the court of common council, of the several boards of commissioners of said city, and of the several committees of said court of common council, shall have the power to compel the attendance and

testimony of witnesses before the respective boards or committees over which they preside, by the issue of subpoenas and the administration of oaths in the manner and according to the rules governing the same in courts of justice, and when it shall be necessary to secure the attendance of witnesses before said boards or committees, the respective chairmen shall have the right to apply to the proper authority for the issue of a capias ad testificandum for that purpose.

SEC. 7. From and after the first day of January, 1878, there shall be a board of finance consisting of the mayor, who shall be presiding officer, four aldermen and two councilmen, to be elected as hereinafter provided, of which said board, the city clerk shall be clerk, which shall meet statedly on the first Thursday of every month, and in the month of November in each year shall make estimates of the moneys necessary to be appropriated for the expenses of said city for the year next ensuing, and of the rate of taxation required to meet the same, and shall classify the said expense under appropriate heads and departments, which said estimates shall be submitted to the court of common council during the first week of the month of December next succeeding, and within five days thereafter shall be published once in each of the daily newspapers in said city, and after such publication, and before the twentieth day of said month of December, said court shall proceed to consider and act upon said estimates, and shall, during said month of December, make such appropriations upon the basis of such estimates as may seem to be necessary and proper to meet the expenses of said city for the year next ensuing, but the total amount of such annual appropriations for any one year shall not exceed the estimated income for that year, nor shall any city or department officer, or board of commissioners of said city, make any expenditures except for the objects and purposes specified by said court of common council, nor shall any city or department office or board of commissioners of said city incur any liability or expense by contract or otherwise for which said city shall be responsible in excess of the appropriations so made by said court of common council.

SEC. 8. The members of the board of finance of said city shall be appointed in the following manner, to wit: the board of aldermen of said city shall, in the month of January, 1878, elect four of their number to be members of said board of finance, two for the term of one year and two for the term of two years, or until others are chosen in their places, and in the month of January in each year thereafter said board of aldermen shall elect two of their number to be members of said

board of finance for the term of two years, or until others are chosen in their places. And in the month of January, 1878, and every year thereafter, the board of councilmen of said city shall elect two of their number to be members of said board of finance for the term of one year, or until others are chosen in their places; but no alderman or councilman shall be elected as a member of said board of finance for any terms longer than their respective terms as aldermen or councilmen.

SEC. 9. The city clerk of said city shall, with any assessment of damages or benefits for the layout of any square, park, highway, bridge or walk, or for any alteration or improvement therein which he is now required by law to publish, also publish the descriptive part of the layout on which such assessment is based, and the date when the same became operative and effectual.

SEC. 10. There shall be a board of commissioners of public buildings of said city, consisting of three members, who shall serve without pay, and who shall have the power and right to enter and examine all school houses and other buildings in which public assemblies are held with reference to their exposure to damage or destruction by fire or other causes, and with reference to the means of egress from such buildings in case of fire, and when said commission find any such building unsafe, or not properly protected, it may report the same to the board of aldermen, with recommendations of such alterations or improvements as may be needed to insure the public safety. And said board of aldermen may order what alterations or im. provements shall be made, and when necessary may direct the corporation counsel to procure the enforcement of its orders by law.

SEC. 11. The board of commissioners of public buildings shall be appointed in the following manner, to wit: at the first meeting of the board of aldermen held in the month of April, 1877, the mayor shall nominate, and with the advice and consent of a majority of the board of aldermen, shall appoint three members to said board of commissioners, to serve for one year from the date of their appointment, and in the month of April, in each succeeding year, there shall be three commissioners appointed in the same manner to said board for one year.

SEC. 12. So much of the act to which this is in addition and alteration, and acts amendatory thereof, as are inconsistent herewith, are hereby repealed.

SEC. 13. This act shall be a public act, and shall take effect from and after the date of its passage. Approved, March 23d, 1877.

AN ACT RELATING TO ELECTORS AND ELECTIONS IN THE TOWN OF NEW HAVEN,

Be it enacted by the Senate and House of Representatives in General Assembly convened: SECTION 1. That the town of New Haven is hereby and shall hereafter be divided into thirteen districts, for voting purposes, as follows: So much of said town as is included within the following boundaries, to wit: by a line commencing at the point of intersection of the central lines of State and George streets, thence continuing northerly through the center of State street to the center of Grove street, thence westerly through the center of Grove street to the center of York street, thence southerly through the center of York street to the center of George street, thence easterly through the center of George street to the point of beginning, shall be and remain district number one.

So much of said town as is included within the following boundaries, to wit: by a line commencing at the point of intersection of the central lines of Chapel and York streets, thence continuing westerly through the center of Chapel street to the town limit, thence following the town limit in a southerly direction to the center of Congress avenue, thence northeasterly through the center of Congress avenue to the center of Davenport avenue, thence northeasterly through the center of Davenport avenue to the center of York street, thence northerly through the center of York street to the point of beginning, shall be and remain district number two.

So much of said town as is included within the following boundaries, to wit: by a line commencing at the point of inter section of the central lines of George and York streets, thence continuing southerly through the center of York street to the center of Davenport avenue, thence southwesterly through the center of Davenport avenue to the center of Congress avenue, thence through the center of Congress avenue to the town limit, thence following the town limit in a southeasterly direction to the center of Washington street, thence northeasterly through the center of Washington street to the center of Congress avenue, thence northeasterly through the center of Congress avenue to the center of George street, thence northwesterly through the center of George street to the point of beginning, shall be and remain district number three.
