Provide for the Registration of Persons carrying A.D. 1923. out certain duties in connection with Landed

Property.

E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, 5 as follows:

1. (1) As from the commencement of this Act Establishthere shall be established for the purposes of this Act a ment and Registration Board (in this Act referred to as "the constitution of RegisBoard") to be called "the Landed Property Practi10 tioners' Registration Board."

(2) The Board shall be a body corporate with perpetual succession and a common seal, and with power to sue and be sued, and to acquire and hold lands for the purposes of this Act without licence in mortmain.

15 (3) The Board shall be constituted in accordance with the provisions contained in the First Schedule to this Act.

(4) The seal of the Board shall be authenticated in the prescribed manner, and any document purporting to 20 be sealed with the said seal so authenticated shall be receivable in evidence of the particulars stated in that document.

2. (1) A register shall be kept by the Board of the Register of names of persons who, on behalf of any other person persons per25 and for or in consideration of any payment or other forming specified

(Registration).

A.D. 1923. remuneration whether monetary or otherwise, undertake or hold themselves out as being able and willing to undertake the following duties (in this Act referred to as "the specified duties "), or any of them :

duties in connection with real estate.

Rules.

(a) the valuation, sale, purchase, letting, taking on 5
lease or other dealing with or disposal of land
or buildings, or any estate or interest in land or
buildings, including tenant right and other agri-
cultural valuations; or

(b) the negotiation for the sale, purchase, letting, 10
taking on lease or other dealing with or disposal
of land or buildings, or any estate or interest in
land or buildings; or

(c) the management of land or buildings or any
estate or interest in land or buildings (other 15
than the supervision of agricultural operations
or the collection of rents); or

(d) the planning, laying out, or development of
land for building purposes; or

(e) the measurement or valuation of dilapidations 20 of buildings; or

(f) the preparation of bills of quantities, and the measurement and valuation of works in connection with the erection, repair, and alteration of buildings.

(2) A certificate under the seal of the Board, duly authenticated in the prescribed manner, stating that any person is, or was, at any date, or is not, or was not, at any date, duly registered under this Act, shall be conclusive evidence in all courts of law of the fact stated 30 in the certificate.

3. (1) The Board shall make rules for the following purposes:

(a) For regulating the formation, maintenance, in-
spection, and publication of the register;
(b) For regulating the conditions of admission to the
register;

(c) For regulating the conduct of any examinations

(whether by the Board or by any other body) which may be prescribed as a condition of 40

admission to the register, and any matters A.D. 1923. ancillary to, or connected with, any such

examinations;

(d) For prescribing the causes for which the conditions
under which, and the manner in which, the
names of any persons may be removed from
the register, and the procedure for the restoration
to the register of the names of any persons
which have been removed therefrom;

(e) For regulating the summoning of meetings of the
Board, and the proceedings (including quorum)
of the Board;

(f) For enabling the Board to constitute committees,
and for authorising the delegation to committees
of any of the powers of the Board, and for
regulating the proceedings (including quorum)
of committees;

(g) For prescribing the mode of application of fees
or other income received by the Board;
(h) Generally for making provisions in regard to any
matters with respect to which the Board think
that provision should be made for the purpose
of carrying this Act into effect (including
provisions with respect to the issue of certificates
to persons registered under this Act), and for
prescribing anything which under, this Act is to
be prescribed.

(2) Every rule made under this section shall be laid before each House of Parliament as soon as may be after 30 it is made, and if an address is presented to His Majesty by either House of Parliament within the next subsequent twenty-one days on which that House has sat next after the rule is laid before it praying that the rule may be annulled or modified, His Majesty in Council may annul 35 or modify the rule, and if annulled it shall thenceforth be void, and if modified it shall thenceforth have effect as so modified, but without prejudice to the validity of anything previously done thereunder.

4. (1) The Board may appoint a person to act as Staff and 40 registrar of the Board, and may employ such other officers expenses. and provide such offices as the Board consider necessary.
