MONEYLENDERS BILL.

Resolution of the House, 16th March, read as follows:

'That on and after the first day of January, nineteen hundred and twenty-eight, there shall be charged on a licence to be taken out annually by a moneylender in Great Britain an excise duty of fifteen pounds or, if the license be taken out not more than six months before the expiration thereof, of ten pounds.'"

Clause 1.

An Amendment proposed, in page 1, line 6, after the word "whether," to insert the words "a person (Mr. Harney).-Question proposed, "That those words be there inserted."

Amendment, by leave, withdrawn.

Another Amendment proposed, in page 1, line 14, to leave out the word "fifteen," in order to insert the word "ten " (Mr. Dennison), instead thereof.- Question, "That the word 'fifteen' stand part of the Clause,"-put, and agreed to.

Another Amendment proposed, in page 2, line 26, at the end, to insert the words:

"(d) where it is proved to the satisfaction of the

Commissioners of Customs and Excise that there is in force a licence for dealing in plate at any premises in respect of which a moneylender's excise licence is taken out by the person so dealing, the Commissioners shall increase the amount of any remission or repayment made to that person by virtue of proviso (c) of this sub-section by a sum equal to the amount of the duty paid in respect of the licence for dealing in plate, or where in any

case moneylenders' excise licences are taken out by partners in a firm in respect of the premises the increase shall be made in the amount of the remission or repayment made to the firm "-(Mr. Womersley).

Another Amendment proposed, in page 2, line 28, to leave out all the words from the word "and" to the end. of sub-section (4), in order to insert the words "shall be void if it be taken out in any other name, but every moneylender's excise licence shall also show the moneylender's authorised name and authorised address "—(Captain King), -instead thereof.-Question, "That the words proposed to be left out down to the word 'which,' in page 3, line 5, stand part of the Clause,"-put, and negatived.

Clause 2.

An Amendment proposed, in page 3, line 37, after the word "and," to insert the words "a separate certificate shall be required in respect of every separate licence" -(Captain King).-Question, "That those words be there inserted,"--put, and agreed to.

Another Amendment proposed, in page 3, line 44, at the end, to insert the words:

(3) Every certificate granted to a moneylender shall show his true name and the name under which, and the address at which, he is authorised by the certificate to carry on business as such, and a certificate shall not authorise a moneylender to carry on business at more than one address, or under more than one name, or under any name which includes the word 'bank,' or otherwise implies that he carries on banking business, and no certificate shall authorise a moneylender to carry on business under any name except

(a) his true name; or

(b) the name of a firm in which he is a partner, not being a firm required by The Registration of Business Names Act, 1916, to be registered;

or

(c) a business name, whether of an individual or of a firm in which he is a partner, under which he or the firm has, at the passing of this Act, been registered for not less than three years both as a moneylender under The Moneylenders Act, 1900, and under The Registration of Business Names Act, 1916"- (Captain King).

Question, "That those words be there inserted,"-put, and agreed to.

Another Amendment proposed, in page 4, line 1, to leave out sub-section (3), in order to insert the words :

"(4) A certificate shall come into force on the date. specified therein, and shall expire on the next following thirty-first day of July "-(Captain King).

Question, "That the words proposed to be left out stand part of the Clause,"-put, and negatived.

Question, "That those words be there inserted,"-put, and agreed to.

Other Amendments made, in page 5, lines 5 and 6, by leaving out the words "a copy," and by inserting the word "copies," instead thereof; and in page 5, line 8, at the end, by inserting the words "and to the Commissioners of Customs and Excise "-(Captain King).

Another Amendment made, in page 5, line 10, by leaving out all the words from the first word "person " to the end of the sub-section, and by inserting the words "is suspended or forfeited, or any person is idsqualified for obtaining a certificate, he may, whether or not he is the person convicted, appeal against the order in the same manner as any person convicted may appeal against his conviction, and the court may, if it thinks fit, pending the appeal, defer the operation of the order" (Captain King),instead thereof.

Clause, as amended, agreed to.
