COURTS OF SUMMARY JURISDICTION.

NOTES.

Table VIII.

(a) This Table includes only offences tried summarily. All Indictable Offences where the Court does not actually assume the power to determine the case summarily are excluded. Further, the Table includes only cases where the proceedings are criminal-that is, lead if successful to a conviction. There are a large number of cases which are quasi-criminal in character, but where the procedure is by complaint, leading, not to a conviction, but to the making of an order. These are provided for in a separate Table-No. IX.

(b) The Table shows the number of persons prosecuted, not the number of offences. Where, therefore, any person is prosecuted at the same time for several offences one offence has to be selected for tabulation, and the rules followed are the same as in Tables I to III. (See note (b) page 37.)

(c) The offences included under each of the titles of offences in Column 1 are stated in Appendix B on page 193.

(d) The Table corresponds to Tables I, II, and III, and (as regards length of sentences) to Tables IV and V.

(e) Columns 4 to 6 include all persons dealt with under Sections 1 and 2 of the Probation of Offenders Act, 1907, the entries being made as follows:

Column 4.-Cases in which, although the charge is proved, the Court, without proceeding to conviction, makes an order dismissing the information or charge (Section 1 (1) (i) of Act).

Column 5.—Similar cases, in which an order is made discharging the offender conditionally on his entering into a recognizance, with or without sureties, to be of good behaviour, and to appear for conviction and sentence when called upon (Section 1 (1) (ii) of Act), but where no probation order is made.

Column 6.-Cases in which a probation order is made, i.e., in which the order for recognizances contains a condition placing the offender under supervision (Section 2 of Act).

(f) Column 7, "Committal to Industrial School," includes only those committals to Industrial Schools where an offence is charged-i.e., committals under Section 58 (2) and (3) of the Children Act, 1908, Sections 45 and 96 (3) of the Education Act, 1921, and Articles 8 and 9 of the Order in Council of the 2nd April, 1909, relative to Day Industrial Schools. Other committals to Industrial Schools where the proceedings are not criminal appear in Table IX. Further information concerning the inmates and management of Industrial Schools is given in the Annual Report of the Children's Branch of the Home Office.

(g) Column 8 includes committals to custody of relatives or other persons, made under Sections 45 (ii) and 96 (4) of the Education Act, 1921, and under Section 58 (7) of the Children Act, 1908, in the cases of children charged with criminal offences, i.e., cases in which a committal to an Industrial School could be made under Section 58 (2) and (3) of the Children Act, 1908.

(h) Column 9 includes persons sent to institutions for defectives or placed under guardianship under Section 8 (1) (b) of the Mental Deficiency Act, 1913, in cases where the Court finds the charge proved but does not proceed to a conviction.

(i) Columns 11 to 17, "Imprisonment without option of Fine," do not include the preliminary imprisonment in Inebriate Reformatory cases, nor terms of imprisonment in default of paying fine or of finding sureties.

(j) Column 19, Reformatory School," contains all cases of persons sentenced to Reformatory School detention, whether they are actually admitted to a reformatory or not. Further information concerning the inmates and management of Reformatory Schools is given in the Annual Report of the Children's Branch of the Home Office.

(k) Columns 21 and 25, "Fine," include all cases where a fine is imposed, whether the fine is paid or not.

(2) Columns 22 and 26, "Recognizances," include all cases where the defendant is ordered to find sureties upon conviction whether the sureties are found or not. Cases where a person is required to find sureties upon complaint are included in Table IX.
