3.-(1) No intoxicating liquor shall, on the premises of any club, be sold or supplied to any person for consumption off the premises.

(2) Section ninety-four of the principal Act shall be read and construed as if the words except to a member on the premises were omitted therefrom.

(a) Members' subscriptions;

(b) Subscriptions from affiliated clubs;

(c) Moneys received from sales of intoxicating liquor;

(d) Moneys received from sales of other refreshments and commodities; and

(e) Moneys expended upon the purchase of intoxicating liquor for the use of the club.

5.-(1) Any police officer of a rank not inferior to 25 that of inspector may, for the purpose of preventing or detecting any violation of any of the provisions of the principal Act, at all times enter on the premises of a club: Provided that an officer when acting under this section shall not wear uniform.

(2) If any person by himself or by any person in his employ or acting by his direction or with his consent, refuses to, or fails to, admit any officer demanding to enter in pursuance of this section, that person shall be liable in respect of each offence to a fine not exceeding 35 in the case of the first offence five pounds, and in the case of any subsequent offence ten pounds.

6. The provisions of the principal Act shall be modified or amended as follows:

(1) The particulars required by subsection (3) of 40 section ninety-two thereof to be given in the

annual return therein mentioned shall include A.D. 1927.
in relation to the preceding year particulars of
the receipts of the club from (a) members' 10 Edw. 7
subscriptions, (b) subscriptions from affiliated 1 Geo. 5.
clubs, (c) proceeds of sale of intoxicating liquor, c. 24.
and (d) proceeds of sale of other refreshments
and commodities, and a duplicate of the annual
statement of purchases of intoxicating liquor
as submitted to the Commissioners of Customs
and Excise in pursuance of section forty-eight
of the Finance (1909-10) Act, 1910:

(2) The following paragraph shall be substituted for
paragraph (e) of subsection (1) of section ninety-
five thereof :-

(e) That the club is habitually conducted
or used mainly for the purpose of supplying
and obtaining intoxicating liquor."

(3) The following subsection shall be substituted for
subsection (2) of the said section ninety-five :

"(2) For the purpose of determining
whether a club is conducted in good faith
as a club the court shall have regard-

(a) to the nature of the premises occupied by the club;

(b) to the provision made by the club of facilities for recreation and other forms of social activity; and

(c) to the extent in quantity and value
of the purchases for the use of the club
of intoxicating liquor during the twelve
months previous to the complaint, and the
ratio which the receipts of the club from
the sale of intoxicating liquor bear to the
receipts from subscriptions and from the
sale of refreshments and commodities other
than intoxicating liquor."

(4) Where on the hearing of a complaint under the
said section ninety-five in respect of any club
any of the grounds mentioned in subsection (1)
of that section as amended by this section has
been established to the satisfaction of the court
but the court has not made an order under that

subsection, then, if on the hearing of a subse-
quent complaint the same ground be again so
established, the court shall make an order
directing the club to be struck off the register,
but any order made in pursuance of this enact- 5
ment shall be subject to appeal to quarter
sessions and sections twenty-nine to thirty-two
of the said Act shall apply to every such appeal
with the substitution of references to the court
from which the appeal is made and the area of 10
the jurisdiction of that court for references to
the licensing justices and the licensing district
for which they act, and of a reference in sub-
section (1) of section twenty-nine to the order
under this enactment for the reference to the 15
refusal to grant a renewal, transfer or special
removal, and with the omission from subsection
(4) of all words after the word "fit."

7. In this Act "club " means registered club.

8.-(1) This Act may be cited as the Clubs Act, 1927. 20 (2) This Act shall be construed as one with the mencement Licensing Acts, 1910 to 1923, and those Acts and this Act may be cited together as the Licensing Acts, 1910 to 1927.
