(Defence against Deer) Bill.

MEMORANDUM.

Small landholders and others in the neighbourhood of deer forests suffer from the depredations of deer. They have no right to kill the deer, and, so far as the common law is concerned, have no claim for damages against anyone, because the wandering deer are wild animals and do not belong to anyone till they are killed or captured.

During the war, under the Defence of the Realm Regulation, No. 2Q, the Board of Agriculture for Scotland made two Orders. (15th January 1917, and 27th September 1918) authorising occupiers of agricultural holdings to kill deer that are trespassing and doing damage. These Orders have lapsed, and this Bill proposes to give the occupier of any agricultural holding in Scotland the right to kill depredating deer along much the same lines.

E it enacted by the King's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the 5 same, as follows:

1.
