Make provision with respect to certain Agencies A.D. 1927. and Registries; and for purposes in connection therewith.

E it enacted by the King's most Excellent Majesty, and with the advice and consent of the Lords Spiritual and Temporal, and Commons in this present Parliament assembled, and by the authority of the same, 5 as follows:

1. (1) This Act applies to every agency or registry Application carried on or represented as being or intended to be of Act, and carried on (whether for the purpose of gain or not) definition of for or in connection with the employment of persons in 10 any capacity, and whether such employment is intended

to be within or without His Majesty's dominions, and, without prejudice and in addition to the foregoing provisions of this section, to every agency or registry carried on or intended to be carried on (whether for the 15 purpose of gain or not) for or in connection with the giving of concerts or other entertainments :

Provided that this Act shall not apply to

(a) any employment agency or registry carried
on by or under the supervision of a
Government Department; or

(b) any employment agency which is

(i) carried on exclusively for the purpose of obtaining employment either for persons formerly members of His Majesty's Naval

(2) In this Act the expression agency means any agency or registry to which this Act applies.

2.-(1) A person shall not carry on an agency 15 without a licence from the local authority authorising him to do so (such licence being hereinafter referred to as "an agency licence.")

(2) If any person carries on an agency without an agency licence he shall be liable upon summary conviction 20 to a fine not exceeding fifty pounds, and if the offence continues after conviction thereof to a further fine not exceeding ten pounds for each day during which the offence so continues:

Provided that if it is alleged and proved that the 25 accused person has so carried on an agency, and that in or in connection with the carrying on of the agency there has been fraud, extortion or immorality, the court may sentence him to be imprisoned, with or without hard labour, for any term not exceeding six months, 30 or to a fine not exceeding two hundred and fifty pounds, or to both such imprisonment and such fine.

Applications 3. (1) A person requiring a licence or the renewal for licences. of a licence under this Act shall make an application in writing to the local authority and shall in the appli- 35 cation state :

(a) His full name.

(b) His age and nationality.

(c) His private address, or if the application is made by or on behalf of a company, society, 40 association or body the registered or principal

office, if any, of such company, society, asso- A.D. 1927;
ciation or body, and, so far as may be reasonably
required, the names and private addresses of
the persons directly or indirectly responsible for
the management of such company, society,
association or body.

(d) The name under which and the address at which
the agency is carried on or proposed to be
carried on.

(e) The nature of the agency.

(f) Whether he is interested in any other agency,
and if so the other agency in which he is
interested, and the extent of his interest therein.
(g) Such other particulars as the local authority
may reasonably require.

(2) Every application under this section shall be in duplicate, and one part shall be retained by the local authority, and the other part shall be forthwith forwarded by the local authority to the chief constable, who may 20 give or make, or cause to be given or made, to the local authority any information or representation with respect to the application that in his opinion ought to be given or made.

(3) Subject to the foregoing provisions of this section 25 the local authority may by regulation prescribe the form of application and the manner in which applications for or for the renewal of agency licences are to be made.

(4) Where any form of application is prescribed by the local authority the prescribed form shall be ob30 tainable from the local authority upon payment of such sum not exceeding one shilling as the local authority may fix.

(5) In this section the expression "chief constable'

means

(a) as respects the City of London, the Commissioner
of the City Police for the time being;

(b) as respects the Metropolitan Police District, the
Commissioner of the Metropolitan Police for
the time being;

(c) elsewhere, the officer having for the time being
the command of the police.
