owner or his agent, the same shall be forfeited to said corporation, its lessees or assigns. The said corporation shall also cause to be entered in a book kept for that purpose the different marks on the logs or timber thus boomed and secured; the number of logs bearing any marks and the amount of lumber cut from said logs bearing such mark or marks, and shall at all times keep such books open for the inspection of all persons. SECTION 3. If any raft of lumber, logs or timber shall by neglect or accident be carried into said boom, it shall not be lawful for the owner, or any person for him to open said boom at any time for the passage of rafts or logs, without at first giving notice to said corporation or its agents.

SECTION 4. This act shall take effect from and after its passage.

CHAPTER 131.

AN ACT to incorporate the Cedarburg academy.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Frederick Hilgen, Conrad Horneffer, William Schroder, Joseph Trottman, Frederick Borner, Jurgen Schroder, William Vogenitz, P. K. Gannon, Heugo Boclo, Theodore Fricke, Theodore Hartwig, Ernst Hilgen and Frederick W. Horn, and such persons as may become associates with them in the manner herein after prescribed, are hereby created a body corporate and politic, with perpetual succession, by the name and style of the "Cedarburg academy," by which name they and their successors shall be forever known, and shall have power to sue and be sued, contract and be contracted with, plead and be impleaded, defend and be defended in all courts of law and equity. Said corporation may have a common seal, and may alter and

break the same at pleasure, and shall have power to acquire, purchase receive, possess, hold and enjoy proerty, real and personal and the same to sell and convey, rent or otherwise dispose of at pleasure: provided, that the cost of the whole amount of real estate owned by said corporation at any one time shall not exceed fifty thousand dollars in value.

SECTION 2. The stock of said corporation shall be Capital stock. divided into shares of ten dollars each, which shall be deemed personal property, and shall be transferable on the books of the said corporation in such manner as shall be directed by the by-laws of said corporation, and every stockholder in said corporation shall, at all meetings of the same, be allowed one vote, either in person or by proxy for each share of stock standing to his name on the books of the corporation, and actually owned by him at the time of such meeting.

SECTION 3. SECTION 5. The said trustees shall have power, and it shall be their duty, immediately after their election as hereinbefore provided, and annually thereafter, to elect one of their number president; and also to elect one of their number a treasurer, and another secretary, and such other officers as the by-laws of said corporation shall require; and all such officers shall 16-P. & L. 1st. To make and establish all needful by-laws for the government and management of the said corpor ation.

2d. To call special meetings of the stockholders to fill vacancies in the board of trustees.

3d. To buy, receive, sell, lease, mortgage or otherwise dispose of, any real or personal estate as shall be deemed by a majority of the trustees for the interest of the corporation.

4th. To employ suitable teachers, and to prescribe the course of study and discipline to be observed in said academy, and the rates of tuition in the same.

5th. To perscribe the duties and fix the amount of compensation of all the teachers and officers of said corporation, and to remove the same for sufficient cause shown.

6th. To make all necessary rules, regulations and bylaws and do all necessary and lawful acts fully to carry out the purposes of this act.

SECTION 6. Said academy shall be located at or near the village of Cedarburg, in the county of Ozaukee. No religious test or qualifications shall ever be required of any trustee, officer, teacher or pupil, nor shall sectarianism in religious matters ever be taught in said academy, but the same shall be an institution for inculcating morality and teaching the arts and sciences.

All sums of money actually paid in as stock subscriptions, and all gifts, bequests, devises and contributions to said corporation shall be faithfully applied by the trustees to carry out the objects of Report and cat- this act, and a report of all receipts and expenditures, and of the financial condition and general standing of the corporation, with a catalogue of students shall be annually made and published by the trustees for the benefit and information of the stockholders.

CHAPTER 132.

AN ACT to extend the time for the collection of taxes in the town of Barton, Washington county.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. The time for the collcetion of taxes in Time extended. in the town of Barton, in the county of Washington, is hereby extended till the first day of May, 1868: provi ded, that this act shall not be so construed as to extend the time for the payment of state taxes.

SECTION 2. The treasurer of said town of Barton shall have the same power and authority to collect the taxes contained in the tax roll last delivered to him after as before such extension of time; and all proceedings to collect any of the taxes in said tax roll shall be as vaild as if made pursuant to the direction of the original warrant.

SECTION 3. This act shall take effect and be in force from and after its passage. Approved February 28, 1868.

AN ACT to amend chapter 306 of the private and local laws of 1866, entitled "an act to consolidate and amend the act to incorporate the city of Berlin, and the several acts amendatory thereof."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section three of chapter three hundred Amended. and six of the private and local laws of 1866, entitled "an act to consolidate and amend the act to incorporate the city of Berlin, and the several acts amendatory thereof," is hereby amended by inserting after the word

"assessor," in the fifth line of said section, the words "one marshal."

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved February 28, 1868.

CHAPTER 134.

AN ACT to authorize Sixtus Hoffman to build and maintain a dock and pier extending into the bay of Superior.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Sixtus Hoffman, his associates, heirs, executors and assigns, are hereby authorized and empowered to build and maintain a dock and pier, extending into the bay of Superior from the land owned by him in Superior City, Wisconsin, viz: lots one (1), two (2) and three (3), in block four (4), according to the recorded plat of said town of Superior City, and to extend said pier into said bay as far as may be necessary to secure good shipping facilities.

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved February 28, 1868.
