Be it enacted by the Legislative Assembly of the Territory of Minnesota, The County officers of Dakota County who were in office on the first day of December, A. D. eighteen hundred and fifty-three, shall each remain in the respective office or offices he then filled until his successor or successors shall be duly qualified; and all the duties pertaining to any such county office that may have been performed as prescribed by law by the said officers, or any of them, since the said thirty-first day of December 1853, shall be legal and valid, as if performed by officers qualified according to law.

SEC. 2. It shall be the duty of the Register of Deeds of said County, on or before the meeting of the Board of Commissioners in February, as hereinafter provided, to make out and lay before said Board at its said meeting a certificate of the election of each person who received the highest number of votes for any office within said county, as shown by the returns of the last general election made to his office, and the persons so shown to have been elected to office in said County may each qualify and assume the duties of his office, as provided by statute, in the same manner, and with all the privileges and penalties which would have attached to said office, if the certificates of election had been issued, and the qualification for the duties of the office had taken place as provided by Jaw.

SEC. 3. It shall be the duty of the Board of County Commissioners to meet at the county seat in said county on the first Monday in February, 1854, at which meeting it shall be competent for said board to transact all business, and do all acts which might or should have been done and performed at the regular session of said Board in January, as provided by law.

SEC. 4. The Board of Commissioners of Dakota County at said meeting in February as above provided, is hereby authorised and required to establish School Districts within their said County, and shall also apportion the moneys appropriated by law for the support of Common Schools within said County, among the School Districts in which schools have been kept since the assessment of the taxes for County revenue, in proportion to the number of persons between the ages of four and twenty-one years, in each district that shall lay before the said Board at said meeting in February, a list of the names of said persons between the ages of four and twenty-one years; said moneys to be drawn from the Treasury after the organization of said School District as provided by law, and the moneys so drawn shall be applied to the purposes for which moneys drawn from the County Treasury for the support of Common Schools are authorised by law to be applied, and no other.

SEC. 5. Until the location of the County Seat of Dakota Coun County seat. ty as provided by law, Mendota shall be the County Seat of said

County.

SEC. 6. The penalties attached by statute for neglect of duty Neglect of duty. in office, shall attach to the officers provided for by this act. SEC. 7. This act shall take effect and be in force from and after its passage, any law to the contrary notwithstanding.

To William P. Murray, for insurance on Territorial Library, from July 13th, 1853, to July 13th, 1854, seventy-five dollars;
